PRIVATIZING OR "INCORPORATING" FEDERAL GOVERNMENT TORTURE, February 26, 2005
Eric Shine shown on the left in dress whites, receiving Congressional and Presidential appointment and Commission to serve as an Officer in the valid Federal Service of the United States Merchant Marine. This honor was conferred on Mr. Shine in 1991 by none other than Vice President Dan Quayle, only because President George HW Bush [King George I] would not make the trip to this Federal Academy himself for some odd reason. The reason for this has become much more clear to Mr. Shine as time has passed on.
The picture shown to the left was taken at graduation ceremonies of the United States Merchant Marine Academy at Kings Point, New York on Long Island in 1991. Kings Point is a sister academy to the other four Federal Academies of West Point, Annapolis, the Air Force and US Coast Guard Academies.
Kings Point and other Federal Academies are some of the most difficult schools to get into in the United States and require Congressional nomination/ appointment and more. Most importantly, the United States Merchant Marine is a valid Federal Service that is often times misunderstood, but only due to misinformation and disinformation that's being intentionally force fed to valid Federal Officers in this Federal Service so that those in control of the industry might continue with the WAR PROFITEERING and more. This is something that has gone on for decades as a valid FEDERAL SERVICE has been sold to the CHINESE and its own Federal Officers tortured under a complex program of subterfuge only so the corporations or Shipping Companies that are actually valid U.S. Federal Agencies could skim funds off the top to fund the political careers of many of this current flock of Robber Barron's.
Now, on the right, Mr. Shine is facing retaliatory prosecution and more from the United States of America, and Department of Homeland Security, and Department of Transportation, and US Coast Guard and other Federal Agencies for "blowing the whistle" on matters affecting Civil Defense and National Security.
This "BE ON THE LOOK OUT" poster or "BOLO" to the right has been published and distributed by the United States against Mr. Shine stating that he "may be dangerous", and the U.S. has done this only in further retaliation. Mr. Shine's actually even been PROSECUTED for "being depressed." Worse, been pulled form C-I-V-I-L court and actually prosecuted for his formal civil complaints, his union grievances and even for his whistle blower letters to CONGRESSMAN DUNCAN HUNTER, to SECRETARY OF TRANSPORTATION NORM MINETA, and to former U.S. COAST GUARD COMMANDANT ADMIRAL LOY [only before Loy "retired" and took over Transportation Safety Administration] and to others. Complaints about gross corruptions within the U.S. Merchant Marine and maritime industry. This BOLO was posted against Mr. Shine in response to his efforts to exercise constitutional rights and also report upon enormous corruptions in the United States Merchant Marine and maritime industry and more. Mr. Shine has been "charged" with "being depressed". [??] One of Mr. Shine's chief complaints is outsourcing of Federal Officer positions and Federal outposts or floating U.S. embassies to the Chinese and others at the expense to enormous Public Trusts.[?] Now Senator Feinstein [through Guillermo Gonzalez - unsure if there is a relation to Alberto Gonzalez or not?] has turned Mr. Shine over to Porter Goss of the CIA through a Miss Nicole Nason who counted Porter Goss her mentor.
So what's really going on in our Federal Government, the U.S. Merchant Marine and issues of "PRIVATIZATION" and more?
The following is a small piece of the pie, even in this man's own story and with what is really going on with our Federal Government and his own and others efforts to report on ignorant, if not clearly unlawful Federal polices that are intentionally marching us into WORLD WAR IV.
A "BOLO" or "Be On the Look Out" wanted poster is what the Federal Government more normally issues and distributes for known convicted criminals who've escaped, or for specific "suspects" in say a particular, even specific crime. Something that's even to be "alleged" with specifications on the "wanted" poster itself, supposedly. Or for say an alleged, specific person who was identified as a "suspect", and is to be alleged and specified on the BOLO only to have carried out a specific act in violation of a specific law, or rule or regulation on a specific day, at a specified time and place. Not anymore! Now you can be charged with even "BEING DEPRESSED" and actually prosecuted for it at Government [taxpayer] expense. Seems that not only are "specifications" no longer required for FEDERAL CONTRACTING on enormous contracts to Haliburton or others, but even now they seem to have been erased from a specification or charge sheet, let alone wanted poster.
Specifications are required by law, rule and regulation, let alone DUE PROCESS. Yet, it appears the united States [or more correctly the incorporated "United States of America"] doesn't even have proper specifications as required in its own "charge sheet" against Mr. Shine. Worse, United States hoped to prove "un-specific", unknown, if not clearly improper specifications through the "hearing process" [somehow]. Apparently, this Judge [one of far too many involved in Mr. Shine's life - in excess of 15 or more Federal Justices] would not even read the specific charges into the record for Mr. Shine and in fact told Mr. Shine that he should somehow "know" what he had done wrong. [!?!]
The "CHARGES" against Mr. Shine by the DEPARTMENT OF HOMELAND SECURITY [NWO - Gestapo] are as follows;

due to a major depressive disorder, or other psychiatric condition, the exact nature of which to be determined through the hearing process.

This is how the "UNITED STATES", while working with corrupt CORPORATIONS and numerous FEDERAL Agencies tries to get an individual to [somehow] violate his FIFTH AMENDMENT rights not only AGAINST self-incrimination, but in violation of DUE PROCESS.
Think "Abu Ghraib" or "Guantanamo Bay", but instead of overseas and against Muslims and others. Yes! How about right here at home in the good ol' US of A? Yes! Where instead it is being carried out upon our own Citizens and in fact even Congressionally and Presidentially Appointed Federal Officers who are our first, and often times last lines of defense against absolute TYRANNY. Look to the recent purges in the CIA, even the Office of Special Counsel for even more proof, if for some reason you cannot believe your own eyes and ears as presented herein, and you need more "proof" somehow. Or look to the recent news about Mr. Bloch as Chief Counsel for the Office of Special Counsel who has dumped over 1,000 WHISTLE BLOWER cases from the OSC with little or no investigations whatsoever.
This is a small piece of the pie in what has gone on in the last four years or more in not only Mr. Shine's life, as now the Federal Government has once again taken up the "sport" of hunting down and killing whistle blowers and its own citizens. Worse, now any and all complainants are hunted down by a combination of Federal Agencies, the Federal Courts, and Corporations and more to somehow DECREE that all complaints are frivolous. It would seem that this might be why the "Neo-Cons" and others are pushing so hard for "mental examinations" or "screenings" now for basically all mankind, especially your "young" children. Worse this program of "mental health examinations is being used as "pre-employment" requirement by many if not most Corporations now. Welcome back the ghost of SENATOR JOE MCCARTHY. Yes, it would appear the "Right" has again taken on the b-r-r-r-right idea [if we may call it that] to euthanize all "liberals" or "Left-ies" by identifying them first as "T-E-R-R-O-R-I-S-T-S" with mandatory "examinations" and then making sure that they are run out of any and all forms of productive life through Summary Decrees and repeated Executive Orders. This has of course been carried out and tried before, right here in America under guidance of "people" or so-called Senators like Senator Joe McCarthy. It is going on again.
Under un-recorded "examinations" a doctor can "identify" you and then once identified make up any "illness" he so chooses, especially if and when it is done to silence you forever. This is in violation of DUE PROCESS and more. It is in violation of the First Amendment!!
The "UNITED STATES" in its numerous and various forms has been forced to resort to this improper tactic and charge against Mr. Shine and only finally, since it could not with the help of numerous Federal Employers as Federal Agencies, even Mr. Shine's own Federal Officer's Labor Union and others, could not finally somehow drive Mr. Shine into breaking any law, rule or regulation, yet. This was so, even though the "United States" in its numerous, various forms has brought to bear enormous pressures upon Mr. Shine to try and get him to finally violate some law, rule or regulation so that he could then finally be charged with something, anything. All of this in the face of horrific violations of his most basic civil and even fundamental human rights. Worse thing is though, they have not given up even with the amount and level of torture that has already been carried out upon him. This "PROGRAM" is to place American Citizens and Federal Officers in compromised positions to FORCE them into going "postal" somehow as they are stripped of everything by some very corrupt and corrupting forces.
The United States does not PROSECUTE someone for "being depressed", seize medical records unlawfully, and even FALSIFY medical records, hold you under such unlawful charges, unless it wants to KILL you through its program of MURDER BY SUICIDE. The United States used Mr. Shine's union grievances, whistle blower letters and even formal CIVIL COMPLAINTS against him as "evidence" somehow. [??]
To show you how serious a "THREAT" Mr. Shine must be to the continued "sovereignty" of the United States, let me show you just a short list of just some of the many forms the "United States" has taken on in actions against Mr. Shine and "protecting" the United States and involved Federal Agencies from Mr. Shine. Of which all have been involved in the life of Mr. Shine and somehow bent on "proving" Mr. Shine is indeed, and in fact tortured into being, and found guilty of "being depresed", but only as the end result of continued abuses and gross violations of contractual, civil, constitutional and even basic human rights. They know they can find him guilty of at least this?

Here is the list of just some names on many of the numerous documents, amounting to hundreds of thousands of pages, that involve this "T-E-R-R-O-R-I-S-T", namely with Mr. Shine's name on them in one way, shape or form;
Department of Homeland Security, Department of Defense, Department of Transportation, Department of Justice, Department of Labor, Office of Labor Management Standards, Federal Labor Relations Authority, Federal Mediation and Conciliation Service, OES, Fish and Game, FBI, US Attorney's Office [who actually blocked a civil rights complaint], US Coast Guard, numerous US District Courts [Central and southern Districts in California], US Circuit Appellate Courts [at least 6 appeals of 03-55935, 03-55937, 03-55938, 0357025, 04-71187 and more], Congress in both Houses by involvement of Senators and Congresspersons [Hunter/ Feinstein/ Boxer/ Bilbray/ Kennedy/ Kerry/ Filner/ Davis/ Clinton and many more], Federal Employers or Shipping companies [including many Federal Agencies as Federal Employers], Military sealift Command, Naval Fleet Auxiliary Force, Woods Hole Observatory Vessels, Washington State Ferries, Alaska State Ferries, Wal-Mart [by its membership and association with the Shipping Companies through the association known as the Pacific Maritime Association], his own Federal Employees Labor Union and even the AFL-CIO as the Parent Organization [both by grant of authority from the United States and as valid Federal Employer who also receive dues and fees from Federal Officers pay], numerous Commissioned and Appointed Federal Officers and Judges and Justices, the Office of Administrative Law Judges, Chief Justice, Transportation Safety Administration, National Transportation Safety Board and so many more..... all intent on NOT allowing him to be heard in any venue or jurisdiction whatsoever as to the Labor Racketeering, False Claims, violations of Federal Contracting laws, gross violations of civil, contractual, constitutional, even human rights of an entire class of Federal Officers and Citizens.

Why are so many enormous parties in interest, focused upon what one individual has to say or tried to bring forth??
Word is that the United States had to open up a new tunnel to store all of the documents in Mr. Shine's FBI and Department of Homeland Security files that seem to keep growing from constant surveilance. WHY [??] So what is it that scares so many Federal Agencies and Federal Employers and Corporations from allowing this man to ever be properly heard about the gross corruptions in the UNITED STATES MERCHANT MARINE and maritime industry??? Intelligence maybe?? Is this guy like MALCOLM X or something? You'd think so by how much time, money, effort and U.S. taxpayer's money that have gone into trying to kill this one man. You think the CIA or someone would just finally put a bullet in him, but I guess that would even make his complaints that much more alarming and brought more into focus somehow?
What does this guy really know or has figured out to cause such an enormous and continuous series of retaliations?
This is a good sign of what your own tax dollars are hard at work doing other then blowing up and then re-building IRAQ and other countries. Only while our own Country falls apart entirely, or better yet, is intentionally driven into insolvency. This is what your money and Public Trusts are being used for. One reason, and only because YOU have not yet helped to put a stop to this, or many other abuses that are being carried out in all our names. If we do not act then we are COMPLICIT in this and other WAR CRIMES that are being carried out from under MILITARY RULE and from under MARTIAL LAW. Its estimated by some, that with all of the involved parties that the "United States", and involved Corporations, wherein these "Corporations" are actualy functioning under special agreements and terms as valid "US Agencies" under what are called General Agency Agreements and spent combined in excess of 10 to 15 million dollars or more in ensuring that Congressionally and Presidentially appointed man, would never be properly heard from in any venue or jurisdiction whatsoever. Never heard from regarding PRIVATEERING and WAR PROFITEERING and other corruptions that have been going on now in the US Merchant Marine and maritime industry for the last several decades. These matters involve people like George HW Bush, George Bush, Chief of Staff Andrew Card, SECTRANS Norm Mineta, Congressman Duncan Hunter, Congressman Dana Rorhbacher, VP Dick Cheney, SECTREAS John Snowe and so many other ROBBER BARRON'S of the 21st century whose GREED is marching us all into WORLD WAR IV.
This comes from an industry that actually "PRAYS FOR WAR" only so as to have sufficient work???
Something that, with all of this taken under full and proper consideration, clearly affects Civil Defense and inseparably National Security. This is not the only industry or sector of the economy, or valid Federal Service that is now affected by this either. Worse, this is intentional and it smacks of all the ingredients of pure unadulterated FASCISM. Its one thing to love your country, your flag, your Constitution and our [ now vacant] Bill of Rights, but not to do so blindly and do so in the face of what's really going on right now in America.
The "United States" has used even this improper/ unlawful action and charges to pull Mr. Shine as a Federal Officer out of Civil Court where the United States had detained him for years without any due process hearing whatsoever, because it was a VALID DEFENDANT.
This was accomplished and he has been denied so much as a DUE PROCESS HEARING in any and al venues and jurisdictions even though he has the statutory right under 28 USCA 1916 to present and prosecute complaints and appeals in his own name without cost. So the intent is clear, strip him of this right so he can never find relief or more global corrections toward what is going on. This is the tip of the iceberg as Federal Maritime Officers are the most highly protected Federal Service under General Maritime and Admiralty Law who are now absent any and all protections and systems of timely due process. This is dangerous. A very, very dangerous position for Federal Officers who help in protecting our borders, our trade, our trade routes and even issues of Civil Defense and National Security, to now be stripped of any and all Constitutional protections as expressed within the Bill of Rights and statutory extensions and expressions of Congress.
This has been accomplished only so as to carry out ongoing tortuous behaviors and violations of the US Constitution and its Bill of Rights against another FEDERAL OFFICER by other FEDERAL OFFICERS, but against a whistle blower to cover-up and obfuscate the truth about what is and has been going on with this valid Federal Service and others. This is FAR WORSE then Abu Ghraib or Guantanamo and is being intentionally covered up by the MEDIA and others since there are so many involved in all of this and it is so widespread.
A civil complaint itself is clearly a "whistle blower" complaint, as is any oral or written complaint. At least that is the way it is supposed to be in America, right? From under our own FIRST AMENDMENT rights? Whether it be in the form of any union grievance, a civil complaint or formal complaints, any whistle blower letters to Congress or any such _expression of a Citizen's right to Free Speech, or moreover the right as expressed by our founding father's to petition its Government for a redress of grievances and actually find timely redress no matter who the parties are, or if it includes the UNITED STATES. We have no sovereign to protect, except all the People of America. We are the sovereign!
To put out BOLO's on someone, let alone a Federal Officer, who has only followed the "peaceful" and prescribed manner for finding a redress on grievances not only for himself, but by so doing, correct a bigger problem adversely affecting rights and protections of all Americans, even foreigners. Even the most recent example of use of these BOLO's was put out late last year, but not for "Mr. Shine", instead for 11 or so TERRORISTS who were somehow "identified" conveniently just prior to the elections. Something that was even posted at the US Postal Offices was only another scare tactic to get everyone looking out for more. What happened to those "TERRORISTS"??
These BOLO's are now used for "T-E-R-R-O-R-I-S-T-S", but supposedly "real" TERRORISTS...right?.. But what or whom defines a terrorist?
Is a Federal Officer like Mr. Shine [like Hans Speidel] now a TERRORIST?
Is it a "trade unionist" like Mr. Shine [like those in Russia and Germany and Chile]? Is it Catholics like Mr. Shine [as professed by Martin Niemoller in his famous decree from WWII]? Is it now again Christians like Mr. Shine? Eagle Scouts like Mr. Shine? Federal Officers? YES!
Did you know the Federal Government under direction of the Department of Homeland Security in its aggressive prosecution against Mr. Shine, somehow used the fact Mr. Shine "believed in Christ", that this was somehow proof of the aforementioned charges????
So is Mr. Shine a "TERRORIST"? Read the TRANSCRIPTS of the record from the DEPARTMENT OF HOMELAND SECURTY.
In the eyes of the Federal Government, that's somehow seemingly overnight morphed into this new-age definition and form of Fascism?
Y-E-S! And so are you if you speak of your Billof Rights, Constitution, Human Rights, Civil Rights or anything along those lines.
Mr. Shine would seem to be a threat or WMD and must be stifled and destroyed under an enormous paper tiger that would have buried anyone under its weight by now. So why and in fact how can Mr. Shine continue to fight on? Why?
What drives him to do so and even what has kept him alive? The desire to act like PAUL REVERE and warn and defend others like you.
So do not ask what you can do for your country, ask and seek out what you can do for your FELLOW COUNTRYMEN. We are our Country. When John F. Kennedy spoke these infamous words he did not mean what you can do for your FEDERAL GOVERNMENT, but what you can do for YOUR COUNTRY, our country here in American is made up, as sovereign, all of our own fellow countrymen [and women].
"WANTED POSTERS" without ANY specifications whatsoever, or what an individual is "alleged" to have done are not "JUST" being used against Muslims or foreigners now. This is happening to Americans who are black, white, male, female, catholic, christia, jewish and who are even valid Federal Officers, even those who were born and raised right here in America. So be warned as there is still time and a way to stop this now, but it is going to take aggressive, assertive and clear action on the part of the American People.
These are WAR CRIMES of the highest order.
True Patriots who believe in the Constitution and its Bill of Rights are under attack and this is not about any foreign "boogie-man". This is about seizing upon your rights as American and Citizens, so as to cover-up gross abuses of Public Trusts through abuses of Public Funds and Public Office. Worse, to place our Country in complete lock-down so when the Country, the stock-market and our lives come crashing down around our ears then those in charge will have paid for their own protections from YOUR pockets and tax dollars. The ultimate scam. This is why the Courts are being barricaded and underfunded intentionally by Congress.
Our Government wants there to be CIVIL UNREST, so it can have an excuse to carry out ABSOLUTE RULE under MILITARY RULE.
Actions like this are a test to see who is watching and how many people will complain as we are ALL stripped of our rights under the guise of "TERRORISM". Whether people like Gary Webb and others actually took their own lives or not, is a matter of debate to some, but not really as either way even if this is so and they did it by their own hand. It is still and will remain to be "MURDER BY SUICIDE". Someone, or something, or some group of individuals or some "force", or even some characteristis of human nature is driving man to attack the "INTELLECTUALS" just like what happened to all those in NAZI GERMANY who were first attacked, made infirm, then attacked again once made into the disabled.

This BOLO poster, which is but a fraction of the story, is an "arrest and detention" warrant like a "WANTED POSTER" and you're asked if you are person of conscience to demand answers NOW from your own Federal Government and rise up and begin to say "NO MORE"!!

DEPARTMENT OF HOMELAND SECURITY and US COAST GUARD issued this poster not only to block Mr. Shine as a valid Federal Officer from being able to properly FILE appeals, but was accomplished to further apply more forms of HARASSMENT in hopes he might get shot and killed, or be driven into some final end in that the United States has gone to great lengths and expense to create, even foster. The "U.S." had Mr. Shine sequestered in a hotal in La Jolla for 7 or 8 months as he was being PROSECUTED for "being depressed", rather then use the $30,000 or more spent on the hotel alone to defend against the seizure of his homes and more and provide proper independent legal aid rather then funnel more money to the valid DEFENDANTS from pre-existing Federal Complaints. Over $200,000 was spent on conflicted counsel who were chosen by the valid defendants from pre-existing Federal Court cases.
Think about it, when pulled over by police this could be used to then "arrest" him for attempting to gain access to a PUBLIC FACILITY??
Any [valid] charges against an individual by the Department of Homeland Security/ US Coast Guard are supposed to be against the LICENSE, not the individual and are supposed to be for a VIOLATION of law, rule or regulation, or what is more normally considered to be an "ACT" of Professional Incompetence. Like dumping OIL! Or running a ferry into the dock and killing people like more recently happened with the Staten Island Ferry. Or carrying out some engineering or navigational error that caused damage to a vessel, or was a safety concern that caused an incident. Like the Exxon Valdez. Not for filing CIVIL COMPLAINTS or for [supposedly being depressed]??
Mr. Shine has been accused of "barratry", "insubordination", "failure to follow a direct order", even "mutiny" and so much more and when the DHS and USCG and others could not get any of these to "stick" and only denied any and all forms of due process and hearings from him also, they then were forced to resort to charges of "medical/ mental incompetence" and charge HIM with the end result of what they had carried out through gross and continuing criminal misconduct. This is standard whistle blower protocol for this Fascist Government.
Now.... by this standard the United States and Corporations [as General Agencies of the United States] can prosecute YOU for getting injured or for being sick at work, especially if you carry or hold any such license like a Bar License, a Dr.'s License, teaching credentials, or any other such certification. Like the teacher in Colorado?? Even if it occurs as a result of GROSS and continuous CIVIL, CONTRACTUAL, CONSTITUTIONAL AND EVEN HUMAN RIGHTS violations. And you WILL be denied due process also. Everything you say can and will be used against you in a court of law!![ ??] Even if you never said it.
Worse. This is one reason also why Pensions are to be there, or are at least are supposed to be there, so that it is NOT in the best interest of the United States or Federal Employers to do this either. Since, as if declared to be "medically/ mentally incompetent" [somehow] then the individual would be due his full pension and benefits, but instead the United States and Federal Employers and Federal Employees Labor Union [as now run allegedly if not clearly by the mafia] has EVEN denied Mr. Shine of any and all pension and other benefits. Overtime is out, medical beneifts are out, civil rights are out, you cannot get sick, you must work late, you are a slave and more, because we ARE AT WAR!!
Mr. Shine was even denied his Federal pay while he was "held" in unlawful and improper Administrative "proceedings" where he is to be considered as "acting under the authority of his Federal license and Congressionally and Residentially appointed position", so that he is paid fully and properly for being there and these proceedings cannot be used in a trumped-up form and fashion to cover up WAR PROFITEERING.
So they get to have your cake and eat it too. So do you know feel better that the war in Iraq was legit? That 9-11 was just a complete failure of all of our enormous systems and protections that allowed a bunch of guys with box-cutters to take over and carry out this fiasco and injure the American people so? And in fact that it was "just a coincidence" that we had a training game going on that very same day of 9-11 that was identical to what happened? But we could never have foreseen this happening? And that the close relationships that this current Cartel or Cabal in DC has with the military-industrial-government and pseudo-religious complex [Carlyle and others] but has nothing to do with what is going on? Then you probably will not feel uncomfortable in a special F.E.M.A. camp designed specifically for you. Or better yet joining up to fight for and defend the American Corporate way? So what is going on in our Congress these days? Especially for guys like Mr. Shine?
Nothing! Even CONGRESS has been informed if Mr. Shine calls or contacts them that they are to call the DC Police immediately.

Recently Mr. Shine was informed as such by GUILLERMO GONZALEZ as Deputy State Director for Senator Feinstein's Office. Mr. Gonzalez was told, as he informed Mr. Shine, when Mr. Gonzalez called the DC Office for the Senator to inquire why the Senator's Offices were being advised to "stay out of it". Mr. Gonzalez informed Mr. Shine, if Mr. Shine were to contact the Senator's offices again they had been informed by DEPARTMENT OF HOMELAND SECURITY to immediately call the DC Police? Remember the DC Police from Michael Moore's movie? Well okay if you haven't yet seen it because of all the bad publicity by FOX News, or realized who Michael Moore's agent is, then maybe it is time to rent it as there are some "interesting" things about Carlyle and so many others.
Mr. Gonzalez, however, was actually "kind enough" to, on behalf of the Senator and Mr. Shine, to send a letter to Nicole Nason who works as an "under-Secretary of Transportation within the Department of Transportation", but who used to work hand-in-hand with PORTER GOSS who now heads up the CIA? Anyone know anything about Mr. Goss and his current purge going on within the CIA and ties to Bush and others? Nice. Real nice. So the "D-E-M-O-C-R-A-T-I-C" Senator turns the whistle blower and civil complainant over to not only the Agency and Department involved, but to what would appear to be some of the very individuals devoted to tearing down our Constitution and its Bill of Rights. Worse the protections for Federal Officers who are attempting to just do their job and not pay for it with their own lives or career.
The DHS and USCG and OALJ used the fact that Mr. Shine as a Congressionally appointed Federal Officer was compelled to get before and inform and report to Congress about what is and has been going on, that this was somehow "proof" that he was "depressed"? What?
The game is to "charge" someone with "being depressed" and then continue to tortue them as they are "held" unlawfully in the administrative process without pay as they LOSE EVERYTHING? Then to force them under an unlawful psychological examination to cover it all up with some "bogus" diagnosis by a clearly corrupted Doctor and more. Should we believe that somehow/ someone is actually going to finally STOP the retaliations and games and MOVE to make Mr. Shine and the People of America more safe and correct these sort of systemic and systematic failures? What do you think? Without your help? NO! With your help? YES! Even now the Bankruptcy Court is counter-prosecuting Mr. Shine and has requeted relief from the "petitioner"??
Now maybe you know why anyone who hears this story and digs deeper should be concerned and not only for Mr. Shine and individuals like him, but for OUR Country as a whole! One of the most repeated phrases now-a-days is about the "chilling effect" that something like that will have on our rights? People!?!? Wake-up we are all pretty well chilled already and if you do not want to end-up at room temperature then people need to start getting together and taking action now. Stop the War. Stop all the wars as they are only being carried out for profit. Stop the "privatization" too, as this is the unlawful seizure of Public Trusts and is different from "Private property".
This is the kind of "happy horsesh--" that is going on in our Federal Government. Against our own People?

Although this "BOLO" looks pretty amateur [thanks to the US Coast Guard and DHS not having graphics people working for them - at least at the time - as this was not yet a major under DHS Programs to re-train yet. This BOLO was issued in 2002/ 2003 or so and is before DHS started making all BOLO's so much prettier and more professional, graphically speaking of course. Like the one issued for all the terrorists.
Put yourself in Mr. Shine's shoes. How would you feel if this was posted against you?
Worse think if you were charged with "being depressed" because your dad was taken ill and then died and you were denied leave and then terminated upon your father's death as only one of the NUMEROUS series of retaliations against Mr. Shine as a vlaid Federal Officer. Worse, beyond the lack of allowing a proper grieving process over the death of his father by carrying out numerous further retaliations, couple this with the improper dissolution of the actual "GRIEVANCE" process for any and all disputes and controversies as paid for by the Federal Government to the Shipping Companies [as Federal Agencies] and Unions to provide for Federal Officers? Wow.
And there is so much more. And it is all to cover-up and obfuscate what Mr. Shine has discovered and tried to report upon.

The US Coast Guard and Department of Homeland Security, do not, as per CONGRESS, have authority over the US Merchant Marine or our contractual matters as they are a separate Federal Service within the Department of Transportation. The US Coast Guard does not have authority over labor disputes, or whistle blower matters or anything else along these lines, but the DHS and US Coast Guard have seized upon all of these in violation of the Separation of Powers and then counter-prosecuted this man for exercising his own and others protected activities. Worse Admiral Loy who was the USCG Commandant at the time, who Mr. Shine wrote a letter to and complained about what was going on, is now playing the same games as the new head of the TSA. Negroponte? Porter Goss?
The United States Coast Guard as now under the Department of Homeland Security performs safety inspections, proctors the engineering and navigation testing for Licensed [and hopefully] degreed Federal Maritime Officers, and other such more once "removed" matters.
What is clearly going on here, is like the CIA "bringing charges" against a Congressman for "being medically/ mentally incompetent" and then prosecuting him/ her for trying to do their job and protect the PEOPLE of America. As another example, the FBI doing the same to someone within the State Department. Congress should start worrying because they are not even safe from what is now taking place in America and if they step out of line, no matter what party or persuasion then off to the "DR" for them too, right? Can they NOT see this somehow?
Things have gotten so crazy now people are taking GREAT license under direction or mis-direction of guys like ASHCROFT and even now Alberto GONZALEZ. You really have to read the DHS/ USCG ALJ's Order that basically ruled Mr. Shine has no rights and this ALJ somehow accepted a "CONTINGENT" Motion of Summary Judgment, which if anyone knows anything about LAW this "CONTINGENT" Motion is absurd and as "minority report-ish" as imaginable. It is charging or predicating a Motion on something that has not yet happened? The ALJ actually argued AGAINST due process seriously! "CONTINGENT"??? Upon what?
In the UNITED STATES proceedings against Mr. Shine for charges of "MEDICAL/ MENTAL INCOMPETENCE" [where he was prosecuted for being "depressed", supposedly] the parties against him were the "UNITED STATES OF AMERICA", the "DEPARTMENT OF HOMELAND SECURITY", the "DEPARTMENT OF TRANSPORTATION", and the "UNITED STATES COAST GUARD"....
This is like PROSECUTING someone for losing their leg in IRAQ, or worse the proecuting them for complaining about it somehow. You would think Mr. Shine must have run a ship aground or done something like JOE HAZELWOOD was accused of doing with the EXXON VALDEZ..
You would think? You really must ask yourself though.
Why would they deny Mr. Shine any "DEFENSE" or even proper "HEARING"? Worse, seize and falsify medical records and more? This guy must be so right on about something, or in fact a lot of things, that he has so many people scared in Washington from their own involvements over the years, that this guy MUST be stifled. Any way possible. Do not let this happen. I guess when the "UNITED STATES" prosecutes someone for "being depressed" in the face of gross human and civil rights violations.
There is no real defense, because anyone would of course be "bummed" to be so screwed over and violated and must be "GUILTY"??
THE PERFECT INDEFENSIBLE ACCUSATION??? Especially now-a-days. Right?
DEPRESSION [irregardless of the reason] is now a crime "Against the State" somehow? This is a trick that has been used for so long against whistle blowers and was outlawed with the Whistle Blower Protection Act and more. But you cannot even use "medical/ mental incompetence" as a defense either, right? Because that is what you are being charged and even prosecuted for aggressively.
A violation of law, rule and regulation is in order? [Yet, this has to do with Mr. Shine's dad taking ill with cancer and fighting for his life for 78 days and then dying and Mr. Shine trying to all the while gain leave and then have proper grievances heard in the neutral forum that no longer exists - but is a line item on Federal Contracts... and so much more....]. WAR PROFITEERING on Federal Contracts set-up to provide for Federal Officers and their own care and benefits and more. This is why PRIVATIZATION is a bad idea all the way around.
The fact that Mr. Shine was "bummed" that his dad was taken ill and then died, and that he was not only denied the ability to process this "grief" as more and more retaliations were dumped on top of him, but in his attempts to enforce his Federal Contacts he found out that his GRIEVANCE AND ARBITRATION process was no more and had been dissolved by the SHIPPING COMPANIES and FEDERAL GOVERNMENT and even UNION and that their FEDERAL CONTRACTS had been dissolved entirely which go to the protection and defense of these FLOATING US EMBASSIES.
This is a performance item in Federal Contracts the American taxpayer provides to protect Federal Officers!
So, are you bummed King George is still in power somehow?
Don't admit it or publish it, as MANDATORY "psychological examinations" will be headed your way. Talk to Bill Frist about this, he has just proposed new legislation in this regard for anyone who "believes" the election was rigged or "fixed." So now truth is an ailment that needs medication, as are true Patriotism and love of Constitution and its inalienable rights as expressed in the Bill of Rights.
The United States tried to force Mr. Shine into one psychological examination, and even though unlawful and when he brought an attorney [and even though conflicted attorney at that, as he was forced upon Mr. Shine by DEFENDANTS from Federal District Court - the conflicted attorney did show] and brought along a VIDEO-GRAPHER. The "DR" refused to have it on the record and the Judge [Federal Administrative Law Judge of the Office of Administrative Law Judges/ DHS as is supposed to be separate from the DHS and USCG, but is not] fought to KEEP IT OFF THE RECORD, and NOT recorded, not to protect Mr. Shine or his rights, but only so they could make up anything they wanted to? The Judge ruled basically, that Mr. Shine must have something to hide since Mr. Shine wanted it to be recorded and ON THE RECORD?
This DHS/ USCG Judge, as have numerous Judges from Federal District Court and others have FOUGHT to keep as much off the record and rule by SUMMARY DECISION, as is humanly possible, and all parties, including Mr. Shine's lawyers have fought to keep him from being heard about what is going on and how widespread and just how many people are involved.
This is only one reason why ALL Court hearings, phone calls, conferences and more should and in fact MUST be recorded, but they are not because ATTORNEYS and the COURTS and the JUDGES are all such "GOOD PEOPLE" and so trustworthy. Right?? And if you believe that I have some land in Florida you might be interested in buying.
Absolute power corrupts absolutely. Interesting? Off the record? No witnesses? All grievances, whistle blower matters, civil complaints, and more all attempted to be decided by a "DR"? The FBI has been involved? The San Diego Offices again? The US ATTORNEY'S OFFICES blocked a CIVIL RIGHTS COMPLAINT? The NINTH CIRCUIT [Kosinski - anti-whistle blower activist and ex-OSC Chief Counsel who was ousted by 43 Senators and now sits atop the 9th Circuit] basically ruled that Mr. Shine had to somehow, and for some odd reason allow the AGENCY carrying out the torture to continue to do so, for as long as it wants to?
WITHOUT SO MUCH AS A DUE PROCESS HEARING.
The "Appeal" and cross-complaint as filed within the DHS/ USCG proceedings has been with the Agency now for over a full year and they clearly plan to sit on this too, unless you are somehow compelled to act to save this man's life............. and in the end help to save yourself.
The BOLO was posted at front gate to the SAN DIEGO US Coast Guard and other facilities, which Mr. Shine was able to obtain copy of, and learned since then its also been posted in standing orders of various Naval bases also.
There is so much more to this story and we hope and intend to bring it to you as quickly as possible, but instead we ask you to go to the story and help bring it to others and DEMAND the "mainstream" media cover this and other such gross abuses of power, position and authority.
Because remember, "UNCLE SAM really does want you". He wants you next.
